Wrongful Death Claims in MA, CT & NH
Massachusetts has a wrongful death law that provides that the decedent’s next of kin may recover damages including funeral and burial expenses, the net income of the decedent that the next of kin could have reasonably been expected to enjoy, and the loss of the services, protection, care, assistance, society, companionship, comfort, and guidance of the decedent. Punitive damages are also available in certain cases.
In Connecticut and New Hampshire, the wrongful death action belongs to the decedent’s estate, and the law provides that the estate may receive compensation for the funeral and burial expenses, medical bills, income that the decedent could have reasonably been expected to earn over the course of his or her life, as well as the most important losses—the joys of life, such as the love and affection of family and friends.
